Use of this website, with or without a plan subscription, constitutes agreement to the following terms and conditions. If you do not agree to these terms and conditions, do not use this website.
1. Purpose of Website
This website is intended as a supplement to private lessons. All instruction should be applied under the guidance of an experienced, qualified private violin teacher. This website and its membership plans do not include access to Joshua Peckins or other teachers.
This website does not include access to music books, scores, or printable sheet music for the pieces and etudes it teaches. In order to study the pieces and etudes taught here, you will need to purchase music for those pieces and etudes, at cost to you. These music books are available from many local music shops, as well as from online retailers. This website does not sell or offer music books, and it is your responsibility to purchase any necessary books from other sources. This website is not affiliated with or endorsed by any music books, methods, schools, teachers, composers, organizations, or independently produced materials that may be referenced on this site, including (but not limited to) specific materials taught in our lessons and specific organizations referenced.
To use this website, you must have Internet access and an up-to-date computer, tablet, or phone capable of accessing the Internet and streaming videos from Vimeo.com. You may incur costs for internet access/data use when using our website. Please contact your internet service provider or mobile data provider for details.
2. Risk of Injury
Playing the violin creates a risk of injury. Never play the violin if it causes pain or fatigue. If you feel any pain, fatigue, or discomfort while playing, stop immediately and consult your doctor. Some instructional materials on this website may offer suggestions about reducing the risk of playing-related injury by adopting certain techniques, following certain practice habits, etc. - these are only suggestions to reduce the risk of injury, and do not eliminate the risk. You agree to hold Joshua Peckins, the Peckins Studio Online, and any associated people or organizations harmless from any injury or loss that may result from playing the violin or following any instructions on this website. Furthermore, you agree that it is your responsibility to consult with your doctor about any pain, fatigue, or discomfort that many result from playing the violin or following instructions on this website. You also agree to consult with your doctor before making any changes to your physical routine, which includes practicing habits.
3. Disclaimers of Warranties and Limitations on Liability
No warrantee or guarantee is offered for our products and services. All videos, website pages, PDF's, emails, and other materials are offered "as is" and “as available” with all faults and without warranty of any kind. We do not guarantee, represent, or warrant that your use of this website will be uninterrupted or error-free.
To the extent permissible under applicable laws, in no event shall the Peckins Studio Online, Joshua Peckins, or any associated people or organizations be liable (jointly or severally) to you for personal injury or any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever.
No guarantee is made about progress or learning that may result from the use of this website. No guarantee is made about the accuracy or completeness of materials on this website.
You agree to hold Joshua Peckins, the Peckins Studio Online, and any associated people or organizations harmless from any harm or damage that may result from your use or attempted use the this website. This includes, but is not limited to, service interruptions, data loss, and data theft, even if notice of such issues has been given to us.
This website, like any website, may occasionally experience temporary down-time due to planned maintenance, technical problems, or other reasons; you may temporarily be unable to access parts or all of the website. These service interruptions are unusual - we strive to maintain uptime - but shall be considered a normal part of website operation. No refunds or other compensation is guaranteed for temporary down-time. We may occasionally choose to offer partial refunds, discounts, or other compensation in the case of temporary down-time; however, this is done at our sole discretion, and does not guarantee any future compensation and does not reflect a change to these Terms and Conditions.
No guarantee is made about future access to lesson videos. We may update this website at any time, without notice, in any way. Possible updates may include, by are not limited to, adding, removing, and replacing videos, PDF’s, website pages, lesson categories/features, other materials, as well as reorganizing the website. Any updates do not affect your membership cost. While it is our hope to add videos over time, this is not guaranteed.
Some membership plans give you access to only some of our content. In this case, you may see other content on our website, but you will not be able to access it without purchasing a different plan that includes access. Content being listed or displayed on this site does not imply access.
4. Cancellation and Refund Policy
To cancel your subscription, log into your account by clicking “Your Account” in the lower-right corner of any page, click "View or cancel plans," click "cancel subscription," enter any word in the text box, and click "Cancel Subscription." (If you see “Log In / Sign Up” in the lower-right corner instead of “Your Account,” you must first log in to your account before completing these steps.) If you cancel, you will retain access until the end of your current membership period, and then your access will end.
You may cancel your plan at any time, and you will not be billed for subsequent membership periods; however, no refunds will be given. For example, if you are on a monthly plan and have paid for the current month, that month's payment is not refundable. If you are on an annual plan, and you have paid for the current year, that year's payment is not refundable. If you cancel your membership before the next billing date, you will not have any subsequent payments.
If you sign up for a free trial, you can cancel your membership before your free trial expires, and you will not be billed. If you do not cancel before your free trial expires, you will be billed for your first membership period and will continue to be billed each membership period until you cancel your subscription. Payments are non-refundable once billed.
If you sign up for multiple membership plans, you will be billed for all of them. To avoid this, if you wish to change plans, you can cancel your old plan before signing up for a new plan. Keep in mind plans are non-refundable, so you should cancel your current plan and wait until the end of the membership period before signing up for a new plan. Signing up for a new plan will not refund payment for any other plans previously billed.
At our sole discretion, we may choose to offer refunds, partial refunds, discounts, or other compensation. This in no way guarantees future refunds, and does not represent a change to these Terms and Conditions.
5. Automatic Renewal and Billing
Your membership will continue and automatically renew until terminated. You agree to automatic renewal and automatic, recurring billing. If you cancel before the billing date, your credit card will not be charged and your plan will be canceled. You must cancel your membership before it renews to avoid being billed for the next membership period. If you do not cancel, your credit card will be billed automatically for the next membership period.
Future prices are not guaranteed. Your membership price is guaranteed through the current membership period that you have already paid for. The price may change in the future; if this happens, you will be notified in advance of any changes.
From time to time, various discounts, coupons, and other promotional offers may be announced. These offers are not guaranteed in the future, and may be revoked at any time.
7. Communication Policy
You may contact us with account-related questions using the contact link in the footer of every page. We do not guarantee responses to any non account-related questions (this includes, but is not limited to, questions specifically for Joshua Peckins, questions about how to play the violin, and questions about any of the content on this website). We generally respond to account-related questions within one business week. Occasionally, a notice will be placed on the contact page, and response time may be significantly longer than one week. If you have concerns that require termination of your account before we can respond to your communication, please see Point Number 4 of these Terms and Conditions, Cancellation and Refund Policy, for instructions about cancelling your subscription.
This website and all its content are copyrighted; all rights reserved. All videos, PDF's, blog posts, webpages, etc. are copyrighted, and are the property of Joshua Peckins - this includes content hosted off-site (e.g., videos hosted on Vimeo or Youtube) which is accessed through this site. You agree to use the materials on this website only for your own, personal and non-commercial use. You agree not to download, copy, share, publicly show, or otherwise distribute any of the materials on this website.
9. Allowed users
You must be at least 18 years old (or the age of majority in your province, territory or country) in order to purchase a membership. Individuals under the age of 18, or applicable age of majority, may use this website only with the involvement of a parent or legal guardian, under such person’s account and otherwise subject to these Terms and Conditions.
If you purchase a membership as part of a school, studio, or other group, you must be part of that group. For example, if a group is offered a discount, special membership plan, or other option to sign-up, that option is exclusive for that group.
Your are responsible for updating your account with any changes to your name, email address, payment information, or other personal information provided to us. You agree to keep your password secret and to maintain exclusive control over your log-in information and account.
If we discover that you are not abiding by these Terms and Conditions, we reserve the right to terminate your account. In this case, you will be offered a pro-rated refund for any time remaining on your current (paid) membership period.
We may enter into partnerships with other organizations or individuals to help promote this website. Those organizations or individuals may be offered a commission in the form of a percentage of revenue generated from their referrals to the Peckins Studio Online. If you have been referred to this website, you may ask the referrer if they are part of our commission program. It is the referring organization’s or individual’s responsibility to disclose any commission to you; you will not be notified by us of any commission.
11. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the state of Massachusetts, USA, without regard to conflict of laws provisions. These terms will not limit any consumer protection rights that you may be entitled to under the mandatory laws of your state of residence.
13. Changes to this Policy
These terms and conditions are subject to change. Any changes will be posted on this web page. A link to this web page is included in the footer of every page on our site. Click the link to return to this page and view the Terms and Conditions at any time. Any changes to these terms and conditions will be effective immediately; provided however, for existing members, such revisions shall, unless otherwise stated, be effective 30 days after posting. Continued use of this website requires acceptance of these terms and conditions.
